These Terms and Conditions ("Terms") govern your access to and use of namehippo.com ("NameHippo," "we," "us," "our") and the services provided through it. By creating an account or completing a purchase, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering binding contracts in your jurisdiction. By using NameHippo, you confirm you meet these requirements.
2. The service
NameHippo is a curated marketplace where premium brandable .com domain names are listed for sale. We facilitate the listing, discovery, negotiation, and escrow-protected transfer of these domains between sellers and buyers.
NameHippo is the seller of record for inventory we own. For third-party listings, we act as an intermediary and clearly label them as such.
3. Buying a domain
3.1 Pricing
The price displayed on each listing is in USD unless otherwise stated. Taxes (GST, VAT) are calculated at checkout based on your billing location.
3.2 Escrow
Every transaction is processed through a licensed escrow service. The escrow provider holds your funds until the domain is transferred to a registrar account under your control. Once you confirm receipt, the funds are released to the seller.
3.3 Transfer
After escrow funding, we provide either an authorization code (EPP) for you to pull the domain to your registrar, or we push the domain directly to a registrar account you specify. Most transfers complete within 1–7 business days.
3.4 Refunds
Domain purchases are final once the transfer completes. If the transfer fails through no fault of yours (e.g., the seller can't deliver), the escrow provider issues a full refund per its standard policy.
4. Selling a domain
(For sellers using NameHippo to list their own inventory.) Sellers warrant that they own the domain free and clear, that no third-party trademark conflicts exist they're aware of, and that they will execute the transfer within 5 business days of escrow funding. Commission rates are disclosed in your seller agreement.
5. Acceptable use
You agree not to:
- Use NameHippo to launder funds, evade taxes, or violate sanctions
- Submit fraudulent payment information or impersonate others
- Scrape the site, reverse-engineer the service, or attack our infrastructure
- Submit listings that infringe trademarks or violate applicable law
- Harass, threaten, or defame other users or our staff
Violations may result in account suspension and forfeiture of pending transactions.
6. Intellectual property
NameHippo, the hippo logo, and all original site content (designs, code, marketing copy) are our intellectual property. You may not copy, redistribute, or commercially exploit any of it without written permission.
AI-generated logo and mockup previews shown on listings are conceptual aids, not transferred IP. You receive only the domain name on purchase, not any logo files.
7. Disclaimers
We provide NameHippo "as is." We don't guarantee that any domain will be "available" indefinitely (prices and availability can change), that the platform will be uninterrupted, or that AI-generated content is error-free. We don't provide legal advice on trademarks — that's your responsibility before purchase.
8. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from your use of NameHippo is capped at the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages, lost profits, or business interruption.
9. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the service, your listings (if you're a seller), or your violation of these Terms.
10. Governing law
These Terms are governed by the laws of India. Any dispute will be resolved in the courts of Pune, Maharashtra, India, except where local consumer-protection law mandates a different forum.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted at least 14 days in advance with a notice on the site or via email.
